In a recent unpublished order, the Nevada Supreme Court granted Pecos Law Group’s request to reverse a family court judge’s decision granting custody of minor children to a non-parent. In its Order, the Supreme Court noted that it agreed with three of the arguments made on behalf of our client.
First, the Court found that the award of custody to the non-parent was an abuse of discretion because that person was never made an actual party to the custody case.
Second, the Court determined that our client’s due process rights had been violated because our client had no notice that the non-parent would be testifying, or that the non-parent would be considered as a custodial placement option.
Third, the Court stated that the family court judge had failed to make specific findings that awarding custody to a parent would be detrimental to the children or that the award of custody to the non-parent was in the children’s best interests.
This successful appeal resulted in the protection of our client’s constitutional rights as a parent.
