In the recent Ohio case of Shalash v. Shalash, the husband sold a business to his mother after the
divorce was initiated. The trial court vacated the transaction and ordered the business transferred to the
wife. The appeals court found that the trial court exceeding its jurisdiction and that the proper remedy
for the husband’s financial misconduct was to include the value of the business in the marital estate. In
Nevada, this marital misconduct is referred to as “martial waste” or “community waste.” The Las Vegas
