Las Vegas Community Property and Divorce Assets Lawyers
When it comes to property division, misconceptions abound. People are consistently surprised that, even if each spouse kept their money separate during the marriage, it all goes into the community property pool, with very few exceptions, and is divided equitably. That includes pensions and retirement accounts. It includes bank accounts that were kept separate. It includes businesses, even businesses such as physician's practices that have no value other than that provided by the spouse who owns and operates it.
At the Pecos Law Group, our first step is to clear up all misconceptions and educate you about how property division works. The next step is to design a legal strategy to protect what is rightfully yours during the divorce process. Our Nevada attorneys have more than 15 years of experience each, and we will put that experience to work for you.
How Do You Divide Community Property?
Community property law requires that all marital property be divided fairly. Although a 50/50 split of assets is fair in many cases, this is not always the case. Each spouse's income and other factors can tip the balance.
Essentially, everything is subject to division, with the exception of assets obtained prior to the marriage and inheritances. Sometimes there is overlap. For example, if a person purchased a home prior to the marriage, the portion of it paid for at that point may not be subject to equitable distribution. However, the portion of the house paid for during the marriage may be subject to division. We will thoroughly review the marital estate to determine what is subject to division and pursue a fair outcome for you.
Does Marital Misconduct Impact Property Division?
Some people believe that the reason for the divorce, such as adultery, can impact property division. It does not. However, financial misconduct may have an impact. Marital waste is the phrase used to describe one spouse gambling away marital assets, spending money on drugs or wasting the family's financial resources in some other way. If such misconduct has taken place in your case, we will make certain that it is accounted for.
